China Commercial’s 30th Anniversary Forum Series on Sustainable Development of New Energy and Green Finance and the Inauguration Ceremony of China Commercial’s Energy and Environmental Law Professional Committee

The year of 2023 will mark the 30th anniversary of China Commercial Law Firm, and also the beginning of the year when China Commercial Law Firm will become the first law firm in Shenzhen with 1,000 lawyers. In the face of broad legal service prospects, lawyers should actively take action to make a good layout of the industry in advance, and enhance the energy and environmental protection related business capacity. In this context, on August 30, the 30th Anniversary Forum: New Energy and Green Finance Sustainable Development Forum and the Establishment Ceremony of China Commercial Energy and Environmental Law Professional Committee was held in the International Conference Center of the Headquarters of China Commercial Law Firm, which was sponsored and launched by China Commercial Law Firm.

The forum was hosted by China Commercial Law Firm, co-organized by WK First, Law Firm Alliance, and Law New Society, and undertaken by China Commercial Energy and Environmental Law Committee and China Commercial Professional and Business Operation Center, which invited a number of experts in the industry to share and exchange views, and explore the strategies to cope with the new situation of the industry, with a view to providing useful references.

At the beginning of the forum, Mr. Gao Shu, the chief partner of China Commercial Law Firm, made an opening speech to express his heartfelt thanks and warm welcome to the keynote speakers and guests. On the occasion of this forum, China Commercial Law Firm New Energy and Environmental Law Committee was also established. Ms. Lu Yashang, Deputy Director of Green Development Center of Beijing Green Exchange, made a keynote speech, taking the Exposure Draft of Greenhouse Gas Voluntary Emission Reduction Trading Management Measures as the starting point, combining theory with practice, explaining the rules of CCER Trading Management Measures in an in-depth manner, and putting forward her own insights and practical suggestions on the progress of carbon trading policies.

Focusing on the core theme of compliance governance in the new energy automotive industry, Mr. Lin Xianwei, Director of Legal Affairs of Desay SV Automotive Co.,Ltd, introduced the enterprise export control system construction and data protection compliance combing to all the guests, and combined with his many years of practical experience and industry observation, he made a detailed and thorough analysis of the new challenges of IP in intelligent networked vehicles – License compliance, and the global M&A compliance risk in 2023.

Mr. Xiong Tao, Executive Director of NIO’s Legal Innovation Institute, gave a comprehensive presentation titled “NIO’s ESG Compliance Requirements and Practices”, systematically clarifying the background of ESG and the regulatory status quo, and at the same time introducing in detail NIO’s management, practices, and performances in the five areas of the environment, product innovation, user management, human resource team building, and corporate governance, and sharing NIO’s determination to build a full-life-cycle carbon footprint management to achieve energy saving and emission reduction.

Mr. Fu Xi Lin, Senior Partner of China Commercial, gave a high level sharing on the topic of “How to Participate in Carbon Market Transactions by Institutions”, which was rich in content, including the concepts of carbon quotas and carbon credits, secondary market transactions by institutions opening accounts and entering into the market, the participation of institutions in the investment and development of environmental rights and interests projects in the primary market, and the new policies and hot laws on the development of the primary market, etc., and also introduced the comprehensive strengths of China Commercial’s energy and environment team and the cases it had undertaken in the past.

Mr. Chen Ming, CEO of AKS Envirotech Inc, focused on the industry hotspots, in-depth interpretation of the EU’s new battery law and the EU’s environmental regulations, and put forward a new concept and new outlook on China’s manufacturing compliance under the global material and environmental regulations with the purpose of “promoting sustainable development with green technology”.

Mr. Fan Hong, Founder of Carbonpass (Guangdong) , gave a speech on “Carbon Footprint and Carbon Compliance in Supply Chain Industry”, in which he said that global sustainable development and China’s carbon neutrality strategy require the participation of the consumer side, and that enterprises need to join hands to build a sustainable supply chain, and that they should focus on building a whole-process, whole-ecology, and whole-compliance digital system to provide core services for the enterprises.

Ms. Chen Haiou, Secretary General of Shenzhen Green Finance Association, introduced the theme of “Green Finance and Financial Compliance” through the refreshing and pleasant tone of the same color, explaining how green finance can contribute to the dual-carbon goal, illustrating the main contents and legal responsibilities of the Shenzhen Green Finance Regulation, the progress of implementation, and looking forward to the innovative practices and development opportunities of green finance in the Greater Bay Area.

Ms. Zhang Xiaoyu, Assistant Secretary General of TDC South China Branch, presented the topic of “Dispute Resolution in the New Energy Industry”, focusing on the industry’s focal points and proposing the need to grasp the characteristics of new energy disputes, give full play to the role of industry experts, and build up a “Carbon Peak and Carbon Neutral” system of policies and regulations, in order to provide practical assistance to all parties in resolving their disputes.

At the end of the forum, Mr. Xie Yin Yin, the director of China Commercial Council of Energy and Environmental Laws, delivered a speech on the stage. Mr. Xie Yin Yin said that the committee will give full play to the comprehensive advantages of China Commercial, in the fields of new energy power generation and traditional energy renewal and iteration based on the structural reform of the energy supply side; the fields of green finance and ESG compliance under the background of the concept of green development; the fields of new energy vehicles, upstream and downstream industries, hydrogen energy production and application, and energy storage, which are promoted by new energy application technologies; the fields of carbon quota, voluntary certified emission reduction (CCER) and green power (certificate), which are promoted by the marketization of environmental rights and interests.
