Introduction
Lin Wei has an educational background in engineering and law. His business areas include IP, antitrust and competition, technology, media and telecommunications, healthcare and life sciences. He provides IP services for well-known internet and high-tech enterprises such as ZTE, Xiaomi, Vivo Technologies, Meituan, Kingsoft Cloud Holdings, Kuaishou and Niu Technologies. His IP services also extend to the Ministry of Transport and other national ministries, as well as Peking University, Qilu Pharmaceutical, Yangtze River Pharmaceutical Group, Pingan Group and other large commercial institutions. In 2008, Lin represented the copyright infringement dispute of the “Struggle” TV series, which became a “red flag standard” in information network dissemination rights infringement cases. In 2009, he represented Tsinghua University in a well-known trademarks and unfair competition case, which was recognised as a typical IP case by the Beijing High People’s Court. In 2015, he represented Xiaomi in winning a case against Qihoo regarding jurisdiction objection, which was chosen as one of the annual top 10 IP innovative cases by Beijing courts. In 2018, his Xiaomi v Li’s right to reputation dispute case was included in the top 10 typical network reputation-related cases of the Primary People’s Court of Haidian District. In 2021, the right of information network dissemination dispute case between Youku and Baidu was selected as one of the 2020 50 typical IP cases of the Supreme People’s Court, the top 10 judicial IP protection cases in Beijing courts, and the top 10 most valuable IP cases in China. The first reversed act preservation of Xinghao Plastic’s patent case was selected as one of the top 10 typical IP cases on technology by the Supreme People’s Court. In 2022, the case of infringement of computer software copyright and trade secret dispute in which he represented LinkBroad
and others against Amtt was selected as one of the top 10 cases involving computer software copyright by the Beijing Intellectual Property Court. The case of unfair competition dispute in which he represented Kuaishou against Henan Piaodu was selected as one of the 2021 top 10 typical IP judicial protection cases by the Henan High People’s Court. He represented Weibo in a case against the “Chao Ji Xing Fan Tuan” app for capturing and using celebrities’ data in Weibo, which was selected as one of the 10 typical cases of new types of disputes over unfair competition by the Haidian District People’s Court. Lin was recognised by China Legal Education and Career Seminar Series as an outstanding young lawyer with special recommendation in 2017. He was selected as one of China’s “A-List” lawyers by China Business Law Journal from 2018 to 2024, and as one of the top ranked lawyers in IP antitrust and competition in litigation by Legalband from 2018 to 2024. He was acknowledged as one of the top 50 Chinese outstanding IP lawyers by Zhichanli and IPR Daily in 2019 and 2023. Legalband named him in its 2020 “Client Choice: Top 15 IP Versatile Practitioners”, 2021 “Special Issue: China Top 15 Lawyers – Automotive & New Energy”, 2022 “Client Choice: Top 15 Compliance Lawyers”, and 2023 “Special Issue: China Top 15 Lawyers – High-tech & AI”. He was included in ACE’s “Top 15 Legaltech Lawyers” list. In 2024, he was recognised in the Chambers Greater China Region Guide and Asialaw Profiles, ranked among Legalband’s “Top 15 Competition Lawyers” and “Top 30 Best of the Best China Lawyers”. Lin is a vice director of the Beijing Lawyers Association’s competition and antitrust law committee and the Chaoyang Lawyers Association’s IP law research committee. He is included in the Beijing IP experts database, is an arbitrator at the Hainan International Arbitration Court, and an external master’s supervisor at Peking University, University of International Business and Economics, and Beijing Foreign Studies University.
