Xu Feifan

Introduction

Xu Feifan is a partner at TianTong Law Firm and the director of its Shanghai office. Xu has a Juris Master degree in civil and commercial law from China University of Political Science and Law and is a senior associate and national first-class human resources management professional.

Since 2014, Xu has gained practical experience in the Internet legal services field, mainly focusing on online copyright infringement disputes, trademark infringement disputes, and unfair competition disputes. Benefiting from her backgrounds in the legal profession and human resources management, Xu takes responsibility for brand building, business development, customer maintenance and management of the TianTong Internet Legal Service Team.

A number of the cases that Xu represented are of pervasive influence, such as the “Soul Land” game adaptation right dispute and the “Candle in the Tomb” unfair competition dispute. Xu has also gained rich practical experience and unique insights in the fields of Internet legal services and electronic evidence laboratory.

Prior to joining TianTong, Xu worked with a well-known enterprise and a Hong Kong-listed company in a number of senior management positions, supervising legal and compliance, human resources, organisation development, and government and public affairs. Xu is a practitioner who utilises human resources management expertise such as organisational well-being, team management, employee career development as well as team performance enhancement in the legal service field.

Additionally, Xu was the founder of a WeChat account — the only one of its kind in the legal industry — empowering law firms with human resources management expertise. By doing so, Xu aims to provide legal professionals with insights into building effective, productive and cohesive teams. Xu is the author of the book A Way to Lawyer’s Excellency.

Representative Cases

The “Soul Land” game adaptation right infringement case: adopted a multi-dimensional comparison method in finding substantial similarity. Won both trials and successfully recovered a total amount of RMB6 million (USD822,000 economic loss for the client. This case was selected as one of the Top 10 IPR Cases in China’s Courts in 2020 by the Supreme People’s Court.

The “Candle in the Tomb” unfair competition case: successfully convinced the court to determine that the “Candle in the Tomb” had no adverse impact despite the Trademark Office’s prior finding of “feudal and superstitious overtones” over “Candle in the Tomb”. The court finally ruled that “Candle in the Tomb” is a unique name for well-known goods and that the rights and interests belonged to the client. The case was selected as one of the Top 10 Model Cases of Judicial Protection of IPR in Jiangsu Courts in 2019 by the Jiangsu High Court.

The case of copyright infringement by boluoxs.com: By using an automatic acquisition tool, the defendants acquired online novels in batches and uploaded them to the privacy website. There were over 400,000 infringed novels involved in this case. The team developed a book list comparison program and a pirated works comparison program to assist relevant authorities in the handling of the case representing China Literature Co. Ltd. This case was selected as one of the Top 10 Legal Supervision Cases of 2020 by the Supreme People’s Procuratorate of the PRC and one of the Top 10 Cases of Combating Infringement and Piracy in Jiangsu Province in 2020 by the Jiangsu High Court.
