Introduction

Charles Feng is the international business department director and a senior partner at Tahota Law Firm’s Beijing office, as well as head of the firm’s digital economy law centre. Feng graduated from Duke Law in the US and China Foreign Affairs University with LLM degrees. He is a reputable IP and data law expert with substantial experience in the above areas as well as anti-trust law with well-known international and Chinese law firms, focusing on IP litigation, prosecution and

enforcement, trademark and patent portfolio management, as well as cyber and data law. Feng has represented numerous foreign clients from the US, the EU, Japan, the UK, Korea and Asean countries at various levels of courts as well as administrative organisations in China. He is particularly experienced in addressing clients’ commercial needs in the areas of IP litigation, arbitration and prosecution, including patent, copyright, trademark and domain names, unfair competition and trade secrets. The team Feng leads consists of experienced lawyers and patent attorneys who can provide IP, data protection, foreign investment and dispute resolution related legal services in Chinese, English, Japanese and French.

Feng has been involved in IP transactional work, including the drafting, negotiation and enforcement of IP assignments or licensing agreements. He is also a certified information privacy professional. He and his team have represented a number of multinationals in dealing with legal matters in relation to cyber security, privacy and data protection. A case handled by Feng was ranked as one of 50 model IP cases by the Supreme People’s Court of China in 2013. In 2019, another of his cases acquired the first preliminary injunction on the basis of trademark infringement and unfair competition from the Shijingshan District Court in Beijing.

As a highly regarded IP expert at home and abroad, Feng serves as a consulting expert to the Guiding Case Research Center of the Supreme People’s Court, a vice director of the Copyright Society of China, an IP expert for the European Commission’s China IPR SME Helpdesk, and a standing committee member of the China Intellectual Property Law Association. He is also a member of the trademark office practice committee of the International Trademark Association, the unfair competition and antitrust committee of the Beijing Bar Association, the American Bar Association, and the China Bar Association.

His professional experience includes working with the non-profit Japan External Trade Organisation and top international and domestic law firms in China such as Baker McKenzie, King & Wood Mallesons, Wanhuida Law Firm, and East & Concord Partners, which gave him valuable insights into the industry.
