Bhog\u516c\u53f8\u7684\u7834\u4ea7\u7a0b\u5e8f\u4e5f\u5df2\u8fdb\u884c\u4e86\u4e00\u6bb5\u65f6\u95f4\u3002\u5176\u4e2d\uff0cShakti Bhog\u6781\u5177\u4ef7\u503c\u7684\u5546\u6807\u5f15\u53d1\u4e86\u77e5\u8bc6\u4ea7\u6743\u5f52\u5c5e\u7684\u4e89\u8bae\u3002<\/p>\n<p style=\"text-align: justify;\">\u5728 <em>Shakti Bhog Foods Ltd and Anr [SBFL] v Kumar Food Industries Ltd and Ors [KFIL]<\/em> \u4e00\u6848\u4e2d\uff0c\u5fb7\u91cc\u9ad8\u9662\u5c31\u5bf9&#8221;Shakti Bhog&#8221;\u9a70\u540d\u5546\u6807\u7684\u4fb5\u6743\u6307\u63a7\u4f5c\u51fa\u4e86\u4e00\u9879\u91cd\u8981\u7684\u4e34\u65f6\u5224\u51b3\u3002SBFL\u662f\u9762\u7c89\u548c\u5927\u7c73\u884c\u4e1a\u9886\u5148\u7684\u98df\u54c1\u751f\u4ea7\u548c\u9500\u552e\u516c\u53f8\uff0c\u5b83\u5411\u6cd5\u9662\u7533\u8bf7\u6c38\u4e45\u7981\u4ee4\uff0c\u58f0\u79f0\u5176\u5546\u6807\u53d7\u5230\u4fb5\u72af\u3001\u5047\u5192\uff0c\u5e76\u8981\u6c42\u635f\u5bb3\u8d54\u507f\u3002KFIL \u63d0\u51fa\u53cd\u8bc9\uff0c\u4e3b\u5f20\u5bf9&#8221;SHAKTI BHOG&#8221;\u5546\u6807\u7684\u6240\u6709\u6743\u3002\u6b64\u6b21\u6240\u6709\u6743\u7ea0\u7eb7\u53d1\u751f\u5728\u7834\u4ea7\u7a0b\u5e8f\u8fdb\u884c\u8fc7\u7a0b\u4e2d\uff0c\u540c\u65f6\u6d89\u53ca\u5546\u6807\u6cd5\uff0c\u6848\u60c5\u590d\u6742\uff0c\u6cd5\u9662\u4e5f\u8be5\u88c1\u5b9a\u5c31\u8fd9\u4e9b\u590d\u6742\u95ee\u9898\u4f5c\u51fa\u88c1\u51b3\u3002<\/p>\n<figure \u4e8e 1975 \u5e74\u8bbe\u7acb\u4e86\u4e00\u5bb6\u72ec\u8d44\u4f01\u4e1a\uff0c\u5e76\u4f7f\u7528&#8221;Shakti Bhog&#8221;\u5546\u6807\u300220 \u4e16\u7eaa 90 \u5e74\u4ee3\u521d\uff0c\u8be5\u88ab\u544a\u8bbe\u7acb\u4e86 SBFL \u548c KFIL \u4e24\u5bb6\u516c\u53f8\u30022017 \u5e74\uff0c\u4ed6\u4ece KFIL \u8f9e\u804c\uff0c\u8be5\u516c\u53f8\u7531\u4ed6\u7684\u513f\u5b50\u548c\u5176\u4ed6\u8463\u4e8b\u7ecf\u8425\u3002SBFL \u56e0 KFIL \u53ca\u5176\u5408\u540c\u5236\u9020\u5546\uff08\u5373\u7b2c\u4e8c\u81f3\u7b2c\u4e5d\u88ab\u544a\uff09\u7ee7\u7eed\u4f7f\u7528\u4e0a\u8ff0\u5546\u6807\u53ca\u5176\u6807\u7b7e\u548c\u5305\u88c5\u800c\u611f\u5230\u4e0d\u6ee1\u3002<\/p>\n<p style=\"text-align: justify;\">SBFL\u8fdb\u5165\u7834\u4ea7\u7a0b\u5e8f\u5df2\u6709\u4e00\u6bb5\u65f6\u95f4\u30022015 \u5e74\uff0cSBFL\u7684\u4e1a\u52a1\u6e05\u76d8\u7533\u8bf7\u63d0\u4ea4\u6cd5\u9662\uff0c\u5e76\u4e8e 2018 \u5e74\u83b7\u5f97\u6cd5\u9662\u6279\u51c6\u30022018 \u5e74\uff0c\u53e6\u4e00\u540d\u503a\u6743\u4eba\u5411\u56fd\u5bb6\u516c\u53f8\u6cd5\u6cd5\u5ead\uff08National Company Law Tribunal \uff0c\u7b80\u79f0NCLT\uff09\u63d0\u8d77\u8bc9\u8bbc\uff0c\u6cd5\u5ead\u4e8e 2023 \u5e74 9 \u6708\u4e0b\u53d1\u4e00\u9879\u547d\u4ee4\u3002\u539f\u544a\u79f0\uff0c\u503a\u6743\u4eba\u59d4\u5458\u4f1a\u6b63\u5728\u6839\u636e 2016 \u5e74\u300a\u7834\u4ea7\u6cd5\u300b\u5c31 SBFL \u4e1a\u52a1\u7684\u516c\u53f8\u7834\u4ea7\u89e3\u51b3\u7a0b\u5e8f\u8fdb\u884c\u8c08\u5224\uff0c\u5e76\u8ba4\u4e3a&#8221;Shakti Bhog&#8221;\u5546\u6807\u662f\u516c\u53f8\u7684\u4e00\u9879\u8d44\u4ea7\uff0c\u5e94\u7eb3\u5165\u516c\u53f8\u7834\u4ea7\u89e3\u51b3\u7a0b\u5e8f\u3002<\/p>\n<p style=\"text-align: justify;\">KFIL\u79f0\u5176\u5df2\u901a\u8fc7 2017 \u5e74 12 \u6708 30 \u65e5\u7b7e\u8ba2\u7684\u8f6c\u8ba9\u5951\u636e\u62e5\u6709\u4e86&#8221;Shakti Bhog&#8221;\u5546\u6807\u7684\u6240\u6709\u6743\u3002SBFL\u8ba4\u4e3a\u8be5\u6587\u4ef6\u662f\u4f2a\u9020\u7684\uff0c\u5e76\u63d0\u51fa\u82e5\u5e72\u7406\u7531\uff1a400\u591a\u4e07\u5370\u5ea6\u5362\u6bd4\uff084.82\u4e07\u7f8e\u5143\uff09\u7684\u5370\u82b1\u7a0e\u5c1a\u672a\u652f\u4ed8\uff0c\u636e\u79f0\u7b7e\u7f72\u8be5\u6587\u4ef6\u7684\u7b2c\u5341\u88ab\u544a\u5f53\u65f6\u4f5c\u4e3aSBFL\u7684\u8463\u4e8b\u5df2\u88ab\u505c\u804c\uff0cKFIL\u7684\u8d22\u52a1\u8bb0\u5f55\u4e0e\u5951\u636e\u5185\u5bb9\u76f8\u51b2\u7a81\uff0cKFIL\u7684\u8d44\u4ea7\u8d1f\u503a\u8868\u4e2d\u6ca1\u6709\u65e0\u5f62\u8d44\u4ea7\u8bb0\u5f55\u3002\u6b64\u524d\u7684\u4e00\u8d77\u6cd5\u5ead\u6848\u4ef6\u663e\u793a\uff0cKumar Food Industries Ltd\u5728\u4ee5&#8221;Shakti Bhog&#8221;\u5546\u6807\u751f\u4ea7\u548c\u9500\u552e\u4ea7\u54c1\u65f6\u4e00\u76f4\u5728\u4f7f\u7528 SBFL \u7684\u8bb8\u53ef\u548c\u5546\u53f7\u3002SBFL\u8ba4\u4e3a\uff0c\u4ee5\u4e0a\u79cd\u79cd\u81ea\u76f8\u77db\u76fe\u7684\u884c\u4e3a\u4ee4\u4eba\u5bf9\u8f6c\u8ba9\u5951\u636e\u7684\u771f\u5b9e\u6027\u548c KFIL\u5bf9\u5546\u6807\u7684\u6743\u5229\u4e3b\u5f20\u4ea7\u751f\u91cd\u5927\u6000\u7591\u3002<\/p>\n<figure id=\"attachment_471531\" aria-describedby=\"caption-attachment-471531\" style=\"width: style=\"text-align: justify;\">SBFL\u8fd8\u4e3b\u5f20\uff0cKFIL\u5e76\u6ca1\u6709\u5411\u4e13\u5229\u3001\u5916\u89c2\u8bbe\u8ba1\u548c\u5546\u6807\u603b\u5c40\u5c40\u957f\uff08Controller General of Patents, Designs and Trade Marks \uff0c\u7b80\u79f0CGPDTM\uff09\u7533\u8bf7\u5546\u6807\u8f6c\u8ba9\uff0c\u5546\u6807\u7eed\u5c55\u624b\u7eed\u4ea6\u7531 SBFL\u529e\u7406\u3002KFIL \u4ea7\u54c1\u7684\u5305\u88c5\u4e5f\u8bf4\u660e\u4e86\u8be5\u5546\u6807\u662f\u5728 SBFL\u7684\u8bb8\u53ef\u4e0b\u4f7f\u7528\u7684\u3002\u5728\u56de\u5e94 SBFL \u4e8e 2023 \u5e74 1 \u6708\u53d1\u51fa\u7684\u505c\u6b62\u4fb5\u6743\u901a\u77e5\u65f6\uff0cKFIL \u6ca1\u6709\u63d0\u51fa\u6240\u8c13\u7684\u8f6c\u8ba9\u5951\u636e\u4f5c\u4e3a\u6297\u8fa9\u7406\u7531\u3002SBFL \u8ba4\u4e3a\uff0c\u8be5\u5546\u6807\u4e0d\u5c5e\u4e8e KFIL\uff0cKFIL \u5bf9 SBFL \u7684\u77e5\u8bc6\u4ea7\u6743\u63d0\u51fa\u7684\u6743\u5229\u4e3b\u5f20\u662f\u6ca1\u6709\u4f9d\u636e\u7684\u3002<\/p>\n<p style=\"text-align: justify;\">\u6cd5\u9662\u53d1\u73b0\uff0cSBFL\u6ce8\u518c\u4e86\u8bb8\u591a\u5546\u6807\u3002KFIL \u5728\u4e3b\u5f20&#8221;SHAKTI BHOG&#8221;\u5546\u6807\u8f6c\u8ba9\u65f6\u6ca1\u6709\u51fa\u793a\u76d6\u7ae0\u7684\u8f6c\u8ba9\u5951\u636e\uff0c\u9664\u4e86\u63d0\u4ea4\u7ed9\u6cd5\u9662\u7684\u4e00\u4efd\u672a\u76d6\u7ae0\u7684\u526f\u672c\u5916\uff0c\u6ca1\u6709\u4efb\u4f55\u5176\u4ed6\u8bb0\u5f55\u3002\u4e3a\u907f\u514d\u635f\u5bb3\uff0c\u6cd5\u9662\u88c1\u5b9a\u503a\u6743\u4eba\u59d4\u5458\u4f1a\u53ef\u5c06\u8be5\u5546\u6807\u89c6\u4e3a SBFL\u7684\u8d44\u4ea7\uff0c\u5e76\u7ee7\u7eed\u4f30\u503c\u7a0b\u5e8f\u3002\u4f46\u662f\uff0c\u503a\u6743\u4eba\u59d4\u5458\u4f1a\u65e0\u6743\u4f5c\u51fa\u6700\u7ec8\u51b3\u5b9a\uff0c\u5fc5\u987b\u7b49\u5f85\u6cd5\u9662\u7684\u5224\u51b3\u3002\u6cd5\u9662\u7981\u6b62 KFIL \u8f6c\u8ba9\u8be5\u5546\u6807\u7684\u4efb\u4f55\u6743\u5229\u3001\u6240\u6709\u6743\u6216\u5229\u76ca\uff0c\u76f4\u81f3\u6cd5\u9662\u4f5c\u51fa\u8fdb\u4e00\u6b65\u5224\u51b3\u3002\u672a\u7ecf\u6cd5\u9662\u6279\u51c6\uff0c\u88ab\u544a\u4e0d\u5f97\u5c31&#8221;Shakti Bhog&#8221;\u54c1\u724c\u4ea7\u54c1\u6388\u4e88\u65b0\u7684\u8bb8\u53ef\uff0cCGPDTM\u4e0d\u5f97\u5c31\u8be5\u5546\u6807\u7684\u8f6c\u8ba9\u6216\u8bb8\u53ef\u8fdb\u884c\u767b\u8bb0\u3002\u88ab\u544a\u4ee5\u5916\u7684\u5408\u540c\u5236\u9020\u5546\u5982\u679c\u5df2\u7ecf\u83b7\u5f97\u8be5\u5546\u6807\u7684\u8bb8\u53ef\uff0c\u5219\u53ef\u4ee5\u63d0\u51fa\u7533\u8bf7\u3002\u6b64\u6848\u5ef6\u671f\u4ee5\u5f85\u8fdb\u4e00\u6b65\u5ba1\u7406\u3002<\/p>\n<p style=\"text-align: justify;\">\u5728\u4fdd\u62a4\u5546\u6807\u6ce8\u518c\u6240\u6709\u4eba\u7684\u5229\u76ca\uff0c\u4f7f\u5176\u514d\u53d7\u53ef\u7591\u7d22\u8d54\u4eba\u4fb5\u5bb3\u7684\u540c\u65f6\uff0c\u6cd5\u9662\u663e\u7136\u4e5f\u4e0d\u60f3\u59a8\u788d\u300a\u7834\u4ea7\u6cd5\u300b\u7a0b\u5e8f\u3002<\/p>\n<p
